Wrongful Termination

Maryland employment attorneys will advise that Maryland is an at will state, i.e., an employer in Maryland can terminate an employee at any time with or without cause. However, an employer may not discharge an employee for an illegal or unlawful reason, such as race, sex, religion, etc. Another exception to the employment at will rule (in other words, reasons for which an employer may not dismiss even an at will employee) is "wrongful discharge in violation of public policy." The public policy exception to the at will employment doctrine holds that an employee who has been discharged in a manner that violates public policy may bring a cause tort action for abusive or wrongful discharge against the former employer. To prevail on such a claim, the plaintiff must prove that his or her employer violated a "clear mandate" of public policy when it terminated his or her employment.
